Welcome to Piklepad, a pickleball and padel community platform operated by Sportwrx Technologies LLP ("Sportwrx Technologies", "Sportwrx", "Piklepad", "we", "us", or "our").

These Terms & Conditions ("Terms") govern your access to and use of the Piklepad website, mobile applications, software, features, content and related services (collectively, the "Platform").

By registering for, accessing or using Piklepad, you agree to these Terms.

If you do not agree with these Terms, please do not use Piklepad.

#1. About Piklepad

Piklepad is a technology platform designed to help pickleball and padel communities:

• Discover players
• Discover clubs and facilities
• Find and create games
• Join games
• Participate in tournaments and events
• Record scores
• View rankings and leaderboards
• Share community content
• Connect with sports communities
• Access other sports-related services

Piklepad may provide technology and tools to clubs, tournament organisers, event organisers and other third parties.

Unless expressly stated otherwise, Piklepad does not itself organise, supervise or control every game, tournament, event or sporting activity listed on the Platform.

#2. Eligibility

You must provide accurate information when creating an account.

You agree that:

• Information you provide is accurate and current.
• You will keep your account information updated.
• You will maintain the security of your account.
• You will not impersonate another person.
• You will not create an account using another person's information without permission.
• You will comply with applicable law.
• You will use Piklepad responsibly.

Certain features may have additional age or eligibility requirements.

#3. Account Registration

Some features require registration.

You may be required to provide:

• Name
• Mobile number
• Email address
• OTP or verification information
• Profile information

You are responsible for activity conducted through your account.

You must notify us if you believe that your account has been accessed without authorisation.

We may suspend or terminate an account where we reasonably believe that:

• These Terms have been violated.
• Fraudulent activity has occurred.
• The account presents a security risk.
• The Platform is being abused.
• The account contains materially false information.
• Suspension or termination is required by law.

#4. Community Conduct

Piklepad is intended to be a respectful sports community.

You must not use Piklepad to:

• Harass, threaten or bully another person
• Promote hatred or discrimination
• Impersonate another person
• Publish unlawful content
• Publish sexually explicit or exploitative content
• Publish content involving child sexual exploitation or abuse
• Publish another person's private information without appropriate permission
• Upload malicious software
• Spam or repeatedly harass users
• Defraud or deceive users
• Manipulate games, scores or rankings dishonestly
• Create fake games or tournaments for fraudulent purposes
• Misrepresent your identity or playing ability for fraudulent purposes
• Interfere with Platform operations
• Attempt unauthorised access to accounts or systems
• Scrape or systematically collect user information without permission
• Use bots or automated systems to abuse the Platform
• Infringe intellectual-property rights
• Violate applicable law

Additional Community Guidelines apply to all users.

#5. User-generated Content

Piklepad may allow users to upload or publish:

• Posts
• Photos
• Videos
• Comments
• Reviews
• Game information
• Tournament information
• Event information
• Profile content

You retain ownership of content that you own and upload.

By publishing content on Piklepad, you grant Sportwrx Technologies LLP a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display, distribute and technically modify that content as reasonably necessary to operate, maintain, promote and improve Piklepad.

You represent that:

• You own the content or have appropriate rights to use it.
• Your content does not infringe another person's rights.
• Your content does not violate applicable law.
• You have appropriate permission to publish identifiable images or information of other individuals where required.

We may remove or restrict content that violates these Terms, applicable law or our Community Guidelines.

#6. Public Content

Certain information may be visible to other users, including:

• Profiles
• Usernames
• Profile photographs
• Games
• Scores
• Rankings
• Tournament participation
• Leaderboard information
• Posts
• Comments
• Photos and videos

You should carefully consider what information you publish publicly.

Piklepad cannot guarantee that information voluntarily published publicly will remain private after it has been viewed, copied or shared by other users.

#7. Games and Player Matching

Piklepad may allow users to create, discover and join games.

Users are responsible for:

• Selecting suitable games
• Reviewing game details
• Communicating with other players
• Arriving at agreed locations
• Following club and facility rules
• Behaving appropriately
• Taking reasonable personal safety precautions

Piklepad does not guarantee that another player will attend a game, perform at a particular level or behave as expected.

#8. Tournaments and Events

Piklepad may provide technology for tournaments and events operated by Piklepad, clubs or third-party organisers.

Individual events may have separate:

• Entry requirements
• Eligibility criteria
• Tournament rules
• Fees
• Cancellation rules
• Refund rules
• Scoring systems
• Venue rules
• Participation requirements

Users must review the applicable tournament or event information before registering.

Where an event is organised by a third party, that organiser may be responsible for conducting the event and complying with its published terms.

#9. Scores, Rankings and Leaderboards

Piklepad may display scores, statistics, rankings and leaderboards.

We generally rely on information submitted through the Platform or by authorised organisers.

We cannot guarantee that every score or result is error-free.

We may correct, modify or remove results where:

• An error is identified
• A result is disputed
• Fraud or manipulation is suspected
• An organiser requests a correction
• Technical problems affected the result

Piklepad rankings are intended for community and sporting purposes unless expressly identified as an official ranking.

#10. Bookings and Third-party Services

Piklepad may integrate with clubs, courts, sports facilities, coaches, organisers and other third-party providers.

Bookings and services may be subject to the third party's:

• Availability
• Terms
• Cancellation policy
• Refund policy
• Venue rules
• Pricing

Piklepad does not guarantee availability or performance of third-party services unless expressly stated.

#11. Payments

Certain Piklepad services may require payment, including:

• Tournament registration
• Event registration
• Court or facility bookings
• Subscriptions
• Premium features
• Club services
• Other paid services

Applicable prices will be displayed before payment where reasonably practicable.

Payments may be processed through third-party payment providers.

You agree to provide accurate payment and billing information.

Payment transactions may be subject to the terms of the relevant payment provider.

#12. Refunds and Cancellations

Refunds and cancellations are governed by the applicable Refund & Cancellation Policy and any event-specific policy displayed at the time of purchase.

Where a tournament or event is operated by a third party, that organiser may determine the applicable refund terms, subject to applicable law.

#13. Intellectual Property

The Piklepad name, logo, trademarks, branding, software, application interface, website design, graphics, text, databases and other materials supplied by Sportwrx Technologies LLP are protected by applicable intellectual-property laws.

You may not, without permission:

• Copy the Platform
• Reproduce Piklepad branding
• Modify the software
• Reverse engineer the Platform
• Sell or sublicense Platform functionality
• Create derivative products based on Piklepad
• Use Piklepad trademarks
• Systematically extract Platform data

All rights not expressly granted remain with Sportwrx Technologies LLP or the applicable rights holder.

#14. Third-party Services

Piklepad may integrate with third-party services, including:

• Payment providers
• Maps
• Sports clubs
• Event organisers
• Communication services
• Analytics providers
• Other technology providers

Third-party services may have separate terms and privacy policies.

Sportwrx Technologies LLP is not responsible for the independent actions, content, policies or availability of third-party services.

#15. Sports and Personal Safety

Participation in pickleball, padel and other physical activities involves inherent risks, including the risk of injury.

You are responsible for determining whether you are able to participate safely.

You should follow appropriate safety practices and comply with the rules of the relevant venue, club, organiser or tournament.

Piklepad does not provide medical advice, diagnosis or treatment.

#16. Platform Availability

We will make reasonable efforts to maintain Piklepad.

However, we do not guarantee that:

• Piklepad will always be available.
• Every feature will always function.
• The Platform will be error-free.
• Information will always be complete or accurate.
• Games or events will always take place.
• Third-party services will always be available.

We may modify, suspend or discontinue features from time to time.

#17. Disclaimer

To the maximum extent permitted by applicable law, Piklepad is provided on an "as available" and "as is" basis.

We do not guarantee the accuracy, completeness, reliability or suitability of information provided by users or third parties.

Piklepad is not responsible for:

• User conduct
• Disputes between users
• Injuries arising from sporting activities
• Third-party venues
• Third-party organisers
• Third-party services
• Events cancelled by organisers
• Incorrect information submitted by users
• Unauthorised account access resulting from failure to protect credentials

Nothing in these Terms excludes liability that cannot legally be excluded.

#18. Limitation of Liability

To the maximum extent permitted by applicable law, Sportwrx Technologies LLP and Piklepad shall not be liable for indirect, incidental, special, consequential or punitive damages arising from use of the Platform.

Where liability cannot legally be excluded, it shall be limited to the maximum extent permitted by applicable law.

#19. Indemnity

To the extent permitted by applicable law, you agree to indemnify and hold harmless Sportwrx Technologies LLP, Piklepad and their officers, employees, contractors and service providers from claims, losses, liabilities, damages and expenses arising from:

• Your misuse of Piklepad
• Your violation of these Terms
• Your violation of another person's rights
• Content you publish
• Your unlawful conduct
• Your violation of applicable law

#20. Reporting Content or Users

If you believe that content or conduct on Piklepad:

• Violates these Terms
• Violates the Community Guidelines
• Is unlawful
• Harasses another person
• Infringes intellectual-property rights
• Involves fraud
• Creates a safety concern
• Involves impersonation

We may investigate reports and take appropriate action.

#21. Grievance Redressal

For complaints relating to Piklepad, content, privacy, user conduct or other Platform matters, please contact our designated grievance contact:

We will process grievances in accordance with applicable law.

#22. Suspension and Termination

We may suspend, restrict or terminate access to Piklepad where reasonably necessary, including where:

• These Terms are violated.
• Fraudulent activity is detected.
• The Platform is being abused.
• An account presents a security risk.
• A user's conduct harms other users.
• Required by applicable law.

You may stop using Piklepad at any time.

Termination does not affect provisions intended to survive termination.

#23. Privacy

Your use of Piklepad is also governed by our Privacy Policy.

The Privacy Policy explains how we collect, use, store and protect personal information.

#24. Changes to These Terms

We may update these Terms from time to time.

Material changes may be communicated through the Platform, email or other appropriate means.

The updated Terms will be published with a revised "Last Updated" date.

Your continued use of Piklepad after the effective date of updated Terms constitutes acceptance of those Terms to the extent permitted by applicable law.

#25. Governing Law and Jurisdiction

These Terms shall be governed by and interpreted in accordance with the laws of India.

Subject to applicable law, disputes arising from or relating to these Terms or your use of Piklepad shall be subject to the jurisdiction of the competent courts located in Mumbai, Maharashtra, India.

#26. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue to apply to the extent permitted by law.

#27. Entire Agreement

These Terms, together with the Privacy Policy, Community Guidelines, Refund & Cancellation Policy and any additional terms applicable to specific services, constitute the agreement between you and Sportwrx Technologies LLP regarding your use of Piklepad.
